This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.parajorganics.com.

Your use of the Website and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Website including the applicable policies which are incorporated herein by way of reference. If you transact on the Website, you shall be subject to the policies that apply to the Website for such transaction. By mere use of the Website, you shall be contracting with Paraj Organics and these terms and conditions including the policies constitute your binding obligations, with Paraj Organics.

For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on the Website by providing Registration Data while registering on the Website as Registered User using the computer systems. Paraj Organics allows User to surf the Website or making purchases without registering on the Website. The term "We", "Us", "Our" shall mean Paraj Organics.

Use of the Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Website. Paraj Organics reserves the right to terminate your membership and / or refuse to provide you with access to the Website if it is brought to Paraj Organics's notice or if it is discovered that you are under the age of 18 years.

If you use the Website, you shall be responsible for maintaining the confidentiality of your Display Name and Password and you shall be responsible for all activities that occur under your Display Name and Password. You agree that if you provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Website and refuse to provide you with access to the Website.

When You use the Website or send emails or other data, information or communication to Us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.

The Website is a platform that Users utilize to meet and interact with one another for their transactions. Paraj Organics is not and cannot be a party to or control in any manner any transaction between the Website's Users.

Henceforward:

• All commercial/contractual terms are offered by and agreed to between buyers and sellers alone.
• Paraj Organics does not make any representation or Warranty as to specifics (such as quality, value, saleability, etc.) of the products or services proposed to be sold or offered to be sold or purchased on the Website.
• Paraj Organics does not implicitly or explicitly support or endorse the sale or purchase of any products or services on the Website.
• Paraj Organics accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
• Paraj Organics is not responsible for any non-performance or breach of any contract entered into between Buyers and Sellers.
• Paraj Organics cannot and does not guarantee that the concerned Buyers and/or Sellers will perform any transaction concluded on the Website.
• Paraj Organics shall not mediate or resolve any dispute or disagreement between Buyers and Sellers.

Membership on the Website is free for buyers. Paraj Organics does not charge any fee for browsing and buying on the Website. Paraj Organics reserves the right to change its Fee Policy from time to time.

In particular, Paraj Organics may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event Paraj Organics reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Policy shall be posted on the Website and such changes shall automatically become effective immediately after they are posted on the Website. Unless otherwise stated, all fees shall be quoted in Indian Rupees.

You agree, undertake and confirm that Your use of Website shall be strictly governed by the following binding principles:

• (e) violates any law for the time being in force;
• (f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
• (g) impersonate another person;
• (h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
• (i) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.
• (j) shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider ("ISPs") or other suppliers;
• (k) You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Website or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Website. We reserve Our right to bar any such activity.
• (l) You shall not attempt to gain unauthorized access to any portion or feature of the Website, or any other systems or networks connected to the Website or to any Server, computer, network, or to any of the services offered on or through the Website, by hacking, password "mining" or any other illegitimate means.
• (m) You shall not probe, scan or test the vulnerability of the Website or any network connected to the Website nor breach the security or authentication measures on the Website or any network connected to the Website. You may not reverse look-up, trace or seek to trace any information on any other User of or visitor to Website, or any other customer, including any Paraj Organics account not owned by You, to its source, or exploit the Website or any service or information made available or offered by or through the Website, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than Your own information, as provided for by the Website.
• (n) You agree that You will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Website or Paraj Organics's systems or networks, or any systems or networks connected to Paraj Organics.

Except as expressly provided in these Terms of Use, no part of the Website and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including "mirroring") to any other computer, server, Website or other medium for publication or distribution or for any commercial enterprise, without Paraj Organics's express prior written consent.

Paraj Organics grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Website. All rights not expressly granted to you in these Terms of Use are reserved and retained by Paraj Organics.

Without prejudice to the forgoing paragraph, Paraj Organics does not warrant that: This Website will be constantly available, or available at all; or The information on this Website is complete, true, accurate or non-misleading.

Paraj Organics will not be liable to You in any way or in relation to the Contents of, or use of, or otherwise in connection with, the Website. Paraj Organics does not warrant that this site; information, Content, materials, product (including software) or services included on or otherwise made available to You through the Website; their servers; or electronic communication sent from Us are free of viruses or other harmful components.

Nothing on Website constitutes, or is meant to constitute, advice of any kind. All the Products sold on Website are governed by different state laws and if Seller is unable to deliver such Products due to implications of different state laws, Seller will return or will give credit for the amount received from buyer that could not be delivered to buyer. You will be required to enter a valid phone number while placing an order on the Website. By registering Your phone number with us, You consent to be contacted by Us via phone calls and / or SMS notifications, in case of any order or shipment or delivery related updates. We will not use Your personal information to initiate any promotional phone calls or SMS.

You shall indemnify and hold harmless Paraj Organics, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, Privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Ahmedabad.

This Website is controlled and operated by Paraj Organics. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. Material on Website is solely for Your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and You must not assist any other person to do so.

Without the prior written consent of the owner, modification of the materials, use of the materials on any other website or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which You receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.

Paraj Organics does not warrant that Product description or other content of this Website is accurate, complete, reliable, current, or error-free. If a product offered by Paraj Organics itself is not as described, your sole remedy is to return it in unused condition.

Cancellation by Paraj Organics: There may be certain orders that Paraj Organics is unable to accept and must cancel. Paraj Organics reserves the right, at Paraj Organics's sole discretion, to refuse or cancel any order for any reason whatsoever. Some situations that may result in Your order being cancelled include, without limitation, non-availability of the product or quantities ordered by You, inaccuracies or errors in pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact You if all or any portion of Your order is cancelled or if additional information is required to accept Your order. If Your order is cancelled after Your credit card has been charged, the said amount will be reversed back in Your Credit Card Account.

Cancellation by the User: In case of requests for order cancellations, Paraj Organics reserves the right to accept or reject requests for order cancellations for any reason whatsoever. As part of usual business practice, if we receive a cancellation notice and the order has not been processed / approved by us, we shall cancel the order and refund the entire amount. A request for cancellation of order shall be valid and accepted only if they are made within 24 hours of making the order on the Site. The User can cancel their order using the "Cancel" link in their "Order History" section of the Site. Paraj Organics will not be able to cancel orders that have already been processed, shipped or delivered. Paraj Organics has the full right to decide whether an order has been processed or not. The User agrees not to dispute the decision made by Paraj Organics and accept Paraj Organics's decision regarding the cancellation.

If any provision of the Terms of Use is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms of Use shall continue to be in full force and effect.
